1.1 Just Jeans Pty Ltd ACN 004 890 037 ("Just Jeans") runs a loyalty program known as JUST SHOP ("Program").
1.2 Just Jeans is a subsidiary of Just Group Limited ACN 096 911 410 ("Just Group").
1.3 Just Group is principally a retailer and as well as Just Jeans, its retail brands include Jay Jays, Dotti, Portmans, Jacqui E, Peter Alexander and Smiggle ("Other Just Group Brands").
1.4 These terms and conditions replace the previous terms and conditions and a new JUST SHOP plastic card with a barcode ("Card") replaces the existing updateable JUST SHOP card ("Previous Card"). These terms and conditions form the basis of the Program and govern the use of the Card and membership of the Program.
1.5 By applying for membership or using the Card, a person:
1.5.1 agrees to be bound by these terms and conditions and any variations to them;
1.5.2 agrees to participate in the Program; and
1.5.3 agrees to receive information and promotions via e-mail, mail and SMS/ MMS (where such information has been provided by that person) from Just Jeans and Other Just Group Brands.
2.1 To become a member of the Program ("Member"):
2.1.1 a person will need to legibly complete and sign the enrolment form (including providing a current email address), hand it to a Participating Just Jeans Store and pay a $5 membership fee. This $5 fee is not refundable. The Member will be issued with a Card in store; or
2.1.2 a person who was an existing member of the Program ("Existing Member"), will not be required to complete an enrolment form nor pay the membership fee again. An Existing Member may be issued with a Card to replace his or her Previous Card. By using the Card, an Existing Member will be bound by these terms and conditions.
2.2 Employees of Just Jeans and employees of subsidiary companies of its parent company, Just Group Ltd are not eligible to join the Program.
2.3 Applicants can only be eligible for one membership each and the issuing of a Card and disqualifying of a Card or Member of the Program is at Just Jeans' sole discretion. Membership is for personal use only. It must not be used by or for a corporation or business and is not transferable.
3.1 To participate in the Program a Member is required to present his or her Card. If a Member does not have his or her Card with him or her, then the Member can identify himself or herself as a Member to Just Jeans by providing personal information, which matches up with the personal information the Member has previously provided to Just Jeans ("Identification"). By providing Identification, a Member will be bound by these terms and conditions as if the Member is using the Card and reference to presenting or using a Card in these terms and conditions also includes where a person provides Identification.
3.2 The Card must be presented at the time of making a purchase at a Participating Just Jeans Store for points to be updated.
3.3 Just Jeans is entitled to regard the person presenting the Card as the Member.
3.4 It is the Member's responsibility to keep the Card and his or her personal information safe and Just Jeans is not responsible for points not utilised by the Member according to these terms and conditions or for stolen, lost or damaged Cards or the failure of a Member to provide the Card at the time of making a purchase.
3.5 If a Card is lost or damaged, a Member may apply for a replacement Card at a Participating Just Jeans Store or by calling the JUST SHOP Enquiry Line on 1800 032 508. Just Jeans may charge a Member $5 for a replacement Card to cover the costs for administration and handling. This $5 fee is not refundable.
3.6 The Card and vouchers in relation to the Program at all times remain the property of Just Jeans.
3.7 For a membership to remain valid, it will need to be "Active". For the membership to remain "Active", a Member must present the Card at a Participating Just Jeans Store and make a purchase within eighteen months of each anniversary of:
3.7.1 the date the Member joined the Program; or
3.7.2 the date these terms came into effect, in the case of an Existing Member.
3.8 If a Member is not "Active", his or her Voucher Points, Status Points and Status Level will be lost. The membership will be re-activated when the Member next makes a purchase at a Participating Just Jeans Store and presents his or her Card. The Member will start in the lowest Status Level and any previous points will not be reinstated.
3.9 It is the responsibility of the Member to check the receipt after each transaction to ensure the details (including the number of points) are correct. It is the responsibility of the Member to provide Just Jeans with any changes to his or her personal details.
4.1 Subject to clauses 3.1, 3.2 and 6.1, one (1) voucher point is awarded to a membership for every one (1) dollar that Member spends to purchase merchandise (rounded up to the nearest whole dollar) at a Participating Just Jeans Store ("Voucher Point").
4.2 For Voucher Points to remain valid, a Member will need to be "Active" which is explained in clauses 3.7 and 3.8 above.
4.3 Existing Members will retain the Voucher Points he or she had earned.
5.1 Subject to clauses 3.1, 3.2 and 6.1, for every one (1) dollar a Member spends to purchase merchandise (rounded up to the nearest whole dollar) at a Participating Just Jeans Store, one (1) status point will be awarded ("Status Point"). Status Points are used to assess status level and privileges according to the status level scale (shown below).
5.2 Member's Status Level is determined based on the number of Status Points the Member earned during a twelve month period, calculated from each anniversary of the date of joining the Program. Status Points do not accumulate beyond the relevant twelve month period. Once a Status Level is achieved, a Member will remain in that level until the Status Points needed for a higher Status Level are accumulated (for example, if in gold, then to move to platinum, a minimum of 1,000 Status Points will be required within a twelve month period calculated from the anniversary of the date of joining the Program. If a minimum of 1,000 Status Points is not achieved within that period, the Member will remain in gold and the Status Points will be removed).
5.3 For a Status Level to remain valid, a Member needs to be "Active" which is explained in clauses 3.7 and 3.8 above.
6.1 Voucher Points and Status Points will not be awarded for any amount spent on alterations of merchandise, for the purchase of Just Jeans gift cards, for the initial membership fee, for any administrative costs if a Card is replaced, nor for any amount spent on merchandise provided by a third party collecting for charitable purposes. Voucher Points and Status Points will be awarded on redemption of a gift card.
6.2 Voucher Points and Status Points for laybys will be awarded on the full value of the purchase price on the establishment of the layby upon presentation of a Card. If an Existing Member has a layby that has not been paid for in full, Voucher Points and Status Points will be awarded on the full value of the purchase price.
6.3 Any Voucher Points or Status Points credited in error or any points relating to a transaction which is cancelled or reversed or where a refund is given, will be deducted.
7.1 A $10 JUST SHOP gift voucher will be awarded for every 200 Voucher Points accumulated ("JUST SHOP Gift Voucher").
7.2 When a JUST SHOP Gift Voucher is provided, the corresponding number of awarded Voucher Points are deducted from the total balance of Voucher Points.
7.3 A JUST SHOP Gift Voucher issued under the Program:
7.3.1 is valid for use at Participating Just Jeans Stores for three months from the date of issue;
7.3.2 can only be redeemed at a Participating Just Jeans Store;
7.3.3 is not transferable, not redeemable for cash and is not a negotiable instrument;
7.3.4 can only be redeemed on a purchase of $15 or more for each JUST SHOP Gift Voucher (for example, if two JUST SHOP Gift Vouchers are used, the purchase must be at least $30); and
7.3.5 will not be replaced if lost, stolen or defaced to the extent it is illegible.
Members may be given the opportunity to enter competitions and receive information, promotions or offers run either by Just Jeans or Other Just Group Brands. Competitions and other information, promotions or offers will be subject to their own terms and conditions which will be available in store, online or provided separately to Members. Competitions may limit certain Members from entering or claiming a prize or offer.
9.1 If a Member no longer wishes to participate in the Program or receive the information or offerings, the Member can withdraw from the Program by notifying Just Jeans in writing to Just Jeans Pty Ltd P.O. Box 2196 Richmond South Victoria 3121.
9.2 Just Jeans reserves the right to vary these terms and conditions at any time and to suspend or cancel the Program and/or the Card at any time upon reasonable notice.
Any notice Just Jeans may wish to provide to the Member shall be regarded as notified to the Member if sent by prepaid post or e-mail addressed to the Member's address provided in the enrolment form, or as otherwise notified in writing to Just Jeans.

A Member can update his or her personal information by contacting the JUST SHOP Enquiry Line on 1800 032 508 between 9am to 5pm Monday to Friday eastern standard time or by filling out a form online or at a Participating Just Jeans Store.

13.2 The purpose for Just Jeans collecting personal information is for a Member to participate in the Program. This privacy statement and these terms and conditions form part of each other. For the purposes of operating the Program, Just Jeans may provide personal information to Other Just Group Brands or to third parties, such as mailing houses and data entry providers. If a person does not provide Just Jeans with information required in the enrolment form, he or she may not be eligible to become a Member or participate in the Program. If a replacement Card is required or a Member needs to change his or her details, Just Jeans may require a form to be filled out with such information that Just Jeans reasonably requires.
14.1 Participating Just Jeans Stores are all Just Jeans Stores in Australia and selected Just Jeans factory outlets. Just Jeans Online is not part of the Program and points will not be awarded for any purchases made on Just Jeans Online. JUST SHOP Gift Vouchers cannot be used for purchases made on Just Jeans Online.
14.2 A copy of the current terms and conditions can be viewed in Participating Just Jeans Stores, at Just Jeans' registered office at 658 Church Street, Richmond, Victoria or online at our website.
14.3 Just Jeans will not be responsible for lost, stolen, illegible or damaged Program vouchers.
14.4 The Card and the technology utilised by the Program depend on third parties and Just Jeans. Just Jeans is not responsible for computer or technological errors or failures, or for fraud.
14.5 Voucher Points, Status Points, JUST SHOP Gift Vouchers and other vouchers issued under the Program are not transferable, are not redeemable for cash and are not negotiable instruments.
14.6 Third parties involved in the program do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Just Jeans and Just Jeans accepts no liability in respect of such representations, warranties or statements.
